Anti-Counterfeit Authority Chair Kabeabea Charged in Ksh6M Bribe Probe

Anti-Counterfeit Authority (ACA) Board Chairperson Josphat Gichunge Kabeabea was today arraigned over allegations that he solicited millions of shillings in bribes from a Chinese businessman to shield him from arrest for allegedly dealing in counterfeit vehicle parts.

Court documents indicate that on November 11, 2025, Kabeabea allegedly asked Du Zhisheng for Ksh5 million, purportedly to ensure he would not be apprehended or prosecuted for trading in counterfeit motor vehicle spare parts.

According to the Prosecution,they say that Kabeabea separately demanded Ksh1 million, again with the promise of stopping any enforcement action against the businessman.

A third request of Ksh300,000 is also listed in the charges.

The prosecution further claims that Kabeabea ended up receiving Ksh144,500 through a mobile number belonging to Ntorui Erastus Kaibi, allegedly as part of the bribe meant to obstruct the businessman’s arrest.

"Court documents show that the accused received Ksh144,500 through the mobile number of Ntorui Erastus Kaibi, money believed to have been sent by the complainant as a bribe to obstruct his arrest,”documents stated.

He now faces an additional charge under the Proceeds of Crime and Anti-Money Laundering Act, accusing him of acquiring the Ksh144,500 knowing,or having reason to believe,that it was illicitly obtained. An alternative count accuses him of being in possession of the same money.

Kabeabea who appeared before Milimani Anti-Corruption Court Principal Magistrate Celesa Okore on Monday, November 17, 2025 denied all the allegations, prompting the court to enter a plea of not guilty.

Magistrate Okore granted him a Ksh2 million bond with one surety or a cash bail of Ksh1 million.

The court also issued several directives whereby it ordered the accused to surrender his passport within 14 days.

The Prosecution was also ordered to supply all evidence to the defense within the same period of 14 days 

The accused was further prohibited from contacting or interfering with witnesses and the further the court barred all parties from discussing the case with the media.

"Further, the court has directed the accused to deposit his passport in court within 14 days and also barred him from interfering with witnesses,"the court ruled.

The case is scheduled for mention on December 8, 2025, before Magistrate Ondiek for further directions.
