Bunge La Mwananchi Moves to High Court Over County Health Facilities’ Bank Accounts
Petitioners challenge directive compelling hospitals to open accounts with Sidian Bank, citing lack of public participation and transparency.
Bunge La Mwananchi has approached the High Court of Kenya to challenge a directive by the Nairobi City County Government that requires all county health facilities to open bank accounts with Sidian Bank.
Filed under a certificate of urgency at the Constitutional and Human Rights Division in Nairobi, the petition is led by Lawrence Oyugi, alongside other members of Bunge La Mwananchi.
They argue that the directive is unconstitutional, unlawful, and procedurally irregular, claiming it was issued without public participation and lacked a transparent and competitive procurement process.
“It is alleged the directive was issued without any form of public participation and that there was no competitive, transparent, or fair procurement process conducted,”the petition read.
The directive, based on a County Executive Committee resolution, instructed all Level 4 and 5 hospitals, as well as officers in charge of other county health facilities, to process documents and open accounts with Sidian Bank.
According to the petitioners, the move threatens the efficient management of public funds, which cover salaries, utility bills, and other operational expenses, and could affect the delivery of health services.
The petitioners are seeking several court orders, including a declaration that the directive is null and void, an order quashing the underlying resolution, a perpetual injunction restraining enforcement, and an interim order suspending the directive pending hearing.
“An Interim and Conservatory Order to suspend the implementation of the directive pending the hearing and determination of the petition,”read the petition.
At the center of the case is whether the Nairobi City County Government followed due process, transparency, and accountability in selecting Sidian Bank as the exclusive banker for all county health facilities.
