Atheists society president in court over fake posts falsely depicting Ruto Lying Dead
The President of the Atheists in Kenya Society, Harrison Nyende Mumia, has been charged with publishing false information after allegedly sharing images online that falsely portrayed President William Ruto as dead or critically ill.
Mumia is accused of making the posts on December 30, 2025, using Instagram and a pseudo-Facebook account.
Prosecutors say Mumia operated the Facebook account under the name Robinson Kipruto Ngetich, where he published an image showing the Head of State lying on a bed and falsely implying that he had died.
Further charges state that Mumia shared additional images through the same account, depicting President Ruto on a hospital bed and suggesting he was in critical condition, information the prosecution says was untrue.
“On December 30, 2025, while at an unknown place within the Republic of Kenya, and using a pseudo-Facebook account under the username Robinson Kipruto Ngetich, you knowingly published false information by posting an image of the President of the Republic of Kenya, His Excellency William Ruto, lying on a bed and falsely portraying him as deceased, information you knew to be false,” part of the charge sheet reads.
According to the court documents indicates that similar images were posted on Instagram, including through Mumia’s personal account @harrisonmumia, where the President was again falsely portrayed as deceased or seriously ill.
The state argues that the posts amounted to the deliberate spread of false information and were capable of misleading the public, contrary to Section 22(1) of the Computer Misuse and Cybercrimes Act No. 5 of 2018.

Mumia who appeared before Milimani Principal Magistrate Dolphina Alego on January 5,2026, where he denied the charges and entered a plea of not guilty.
His counsel, Levi Munyeri asked the court to release him on bond, arguing that his client was not a flight risk and that his place of residence was well known.
In her ruling, Magistrate Alego granted Mumia a bond of sh1 million with a similar surety, or an alternative cash bail of sh500,000, and directed that the accused provide two contact persons as part of the bond terms.
The case will be mentioned on January 19, 2026, as the prosecution prepares to proceed with the matter.
