During the hearing, Ngathe’s lawyer made two applications which was for reasonable bail, noting that Ngathe is a tractor driver employed on Kenya Rural Roads Authority road works, and the tractor allegedly involved in the incident was part of official work.
The counsel added, "The accused is fully employed, has a fixed home, and is the breadwinner of his family. He undertakes to abide by the court and appear as required."
Counsel also added that there was no compelling reason why the accused should not be granted reasonable bail.
In his second application,he asked the court the release of the tractor, which the court directed Ngathe to file formally.
In his ruling, Chief Magistrate Onyina ordered that Ngathe be supplied with copies of witness statements, giving him enough time to prepare for trial.
The magistrate ruled that, "The accused is hereby granted bond of Sh 100,000 with one contact person or alternative bail of similar amount with a surety."
The prosecution did not object to bail but requested one week to provide the documents.
Ngathe according to his counsel had previously been on police bail of Sh 30,000, which was returned upon his appearance in court.
The matter was adjourned for pretrial mention on January 28, 2026, giving both sides time to prepare for the next stage of the case.
