Delivering the judgment at the Milimani Law Courts, Chief Magistrate Lucas Onyina stated:
“Each of the fifth, sixth and seventh accused persons is not guilty of counts numbers 1, 2 and 3 and is each acquitted of the said counts.”
The Milimani court further directed:
“The seventh accused person, who has been acquitted of all the counts, is ordered to be set at liberty unless otherwise lawfully held.”
The court heard that Gichamba had been arrested after a Nokia phone stolen from one of the robbery victims was taken to his workplace for charging by one of the accused persons, Raphael Kimani Gachii, and his alleged girlfriend Margaret Njeri Wachiuri, the sixth accused.
However, the court found that the prosecution had failed to link Gichamba directly to the robberies, noting that he had merely handled the phone in the course of his work.
Gichamba had been charged alongside Erick Muyera Isabwa, Raphael Kimani Gachii, Mustafa Kimani Anyonyi, Stephen Astiva Lipapo, Jane Wanjiru Kamau, and Margaret Njeri Wachiuri who have today been convicted of the charges.
Gichamba the seventh accused who had been held in Kamiti maximum prison for eleven years was finally set free by the court.
The case arose from a series of violent robberies carried out hours before the fatal shooting of Muchai and his aides at the Kenyatta Avenue–Uhuru Highway roundabout in February 2015.
The matter is headed for sentencing on March 18,2026.
