Court releases suspects arrested over CBD fuel protest obstruction charges

Twelve suspects, among them two minors, have been released by a Nairobi court after being charged over alleged obstruction of traffic along Moi Avenue in the Central Business District during a fuel protest at the Archives area.

Ten of the accused denied the charge of wilfully obstructing the free passage of a public street contrary to Section 11(1)(a) as read with Section 11(2) of the Nairobi City County Public Nuisance Act, 2021.

Through their lawyer Ian Njuguna, the defence urged the court to release the suspects on free bond, arguing that the offence is a misdemeanour and that they have known places of abode and are not flight risks.

 “Your honour, this is a misdemeanour. The accused have known places of abode and are not a flight risk. We urge the court to release them on free bond,” the defence submitted.

The defence also sought clarification on whether the prosecution intended to amend the charge sheet.

The prosecution, however, told the court that there was no evidence confirming that the seventh and eighth accused persons are minors and requested that they undergo age assessment before plea taking.

“The prosecution submits that there is no evidence confirming the ages of the seventh and eighth accused persons and prays that they be subjected to age assessment before plea is taken,” the court was informed.

The court directed that the two be taken for age assessment and be presented the following day for confirmation of their ages.

All the accused were released on a cash bail of Sh3,000 each.

They were arrested on April 21,2026 during demonstrations over rising fuel prices within Nairobi’s Central Business District.

The matter will be mentioned on May 7 for pre-trial directions.
