High Court Advocate Remanded Over Alleged Sh 7.59M Client Fraud Case

An advocate of the High Court is set to remain in custody pending a ruling on his bail application after he denied charges of stealing by conversion and making documents without authority.

Paul Kimani Mwangi appeared before Magistrate Wandia Nyamu at the Makadara Law Courts, where he is accused of unlawfully receiving Sh 7,590,000 from his client, Joseph Kimani Muchiri, through transactions said to have taken place between June 2023 and March 2025.

The prosecution told the court that the dispute revolves around financial documents allegedly used to create the impression that payments had been processed.

It was claimed that a KCB bank credit advice was falsified to indicate a transfer of funds, while KRA domestic payment slips were also allegedly prepared to support the same transactions.

 Investigators believe the documents were used to validate property-related payments and assure the complainant that the money had been properly handled.

Mwangi faces charges of stealing by conversion of Sh 7,590,000, making documents without authority, and forgery of financial records.

His lawyer opposed the prosecution’s bid to deny him bail, telling the court that he is an advocate of the High Court of Kenya who understands court procedures and would comply with any conditions set. 

The defence urged the court to grant reasonable bail terms, saying he is ready to attend court throughout the proceedings.

“He is an advocate of the High Court of Kenya and will abide by the court’s decision as he understands the rules,” the defence submitted.

The prosecution, however, objected to his release, arguing that he has no known place of residence after allegedly shutting down his office. 

They also told the court that efforts to trace him through family members had not been successful, describing him as a flight risk.

 “The accused has no known place of abode… This clearly shows that he is a flight risk,” the prosecution said.

The presiding Magistrate directed the defence to respond to the prosecution’s affidavit before making a determination on bail. 

Mwangi remains in custody as the court considers the application.

 The matter will be mentioned on April 29, 2026.
