Man Charged Over Alleged Sh25 Million Eastleigh Land Forgery, Freed on Bond

Abdul Hassan Tahalil has denied charges of forgery and uttering a false document in connection with a disputed parcel of land in Nairobi's Eastleigh area valued at KSh25 million.

Tahalil appeared before the Milimani Chief Magistrate's Court before Chief Magistrate Lucas Onyina on Thursday, where he pleaded not guilty to two criminal charges linked to land parcel LR No. 36/1/18.

According to the prosecution, Tahalil is accused of forging an indenture for the property and presenting it as a genuine legal document.

Prosecutors allege that "on or before August 10, 2022, he jointly with others not before the court, forged the title document with the intention of defrauding Mary Wairimu Muhoro of the prime property.."

He also faces a second charge of uttering a false document. The prosecution claims that on November 30, 2022, at the Environment and Land Court in Nairobi, Tahalil knowingly presented the allegedly forged indenture in Civil Suit No. 409 of 2022, falsely representing it as a genuine document drawn by the law firm of CK Advocates.

Before plea was taken, the defence had sought to defer the plea, arguing that the request was necessary to safeguard the integrity of the criminal justice process.

Defence counsel told the court that the application was intended to ensure what he described as "hygiene in the criminal justice process" and to prevent any possible abuse of the court process, especially given the existence of related proceedings before the Environment and Land Court.

The prosecution strongly opposed the application and urged the court to dismiss it. Counsel for the complainant also supported the prosecution's position, arguing that no material evidence or documents had been presented to justify delaying plea taking.

 He submitted that both the complainant and the accused were entitled to justice and that the matter should proceed without unnecessary delay.

The court agreed with the prosecution and directed that plea be taken immediately.

After Tahalil entered a not guilty plea, the court ordered the prosecution to supply the defence with all witness statements and documentary evidence it intends to rely on during the trial.

In seeking his release on bail, the defence described Tahalil as a Kenyan citizen with a fixed place of residence and no flight risk.

Counsel further told the court that he is the sole breadwinner of his family and supports his elderly and ailing parents, who depend on him for their daily upkeep and medication. 

The defence also noted that this was his first appearance before a criminal court and urged the magistrate to grant lenient bond terms, including a free bond with sureties.

The prosecution did not oppose his release on bail but asked the court to impose terms commensurate with the seriousness of the charges.

The court released Tahalil on a bond of Sh1 million with one surety of a similar amount, or an alternative cash bail of Sh500,000. He was also required to provide two contact persons.

The case will be mentioned on May 6, 2026, for pretrial directions before Court 2.
