Sh60M Government Tender Scam Suspect Seeks Bail at Milimani Court

A Nairobi court heard a bail application in a case involving a suspect accused of orchestrating a Sh60 million government tender scam linked to allegations of fraud, forgery, and obtaining money by false pretences.

The prosecution alleges that "between September and December 2023, Joy Wangari Kamau conspired to defraud a complainant, Vijay Virma, by falsely claiming she could secure a government tender for the supply of laptops and accessories to the Ministry of Information, Communication and Digital Economy.”prosecution alleged.

Wangari is further accused of obtaining USD 398,000 (approximately Sh60 million) through the alleged scheme and forging a Request for Quotation document referenced MICT/VOL.I/VACC/2023-1 to make the transaction appear legitimate.

The accused denied all charges when she appeared before the Milimani Law Courts, where she is facing three counts arising from the alleged procurement fraud.

The court was informed that she was arrested on March 30, 2026, and first presented before the court on March 31, 2026 for plea taking.

The matter is being prosecuted by the Office of the Director of Public Prosecutions (ODPP) following investigations by the Directorate of Criminal Investigations (DCI).

During the bail hearing, defence counsel told the court that the accused has cooperated with investigators, complied with summons, and provided information during the investigation process.

The defence argued that she is not a flight risk and urged the court to grant reasonable bail terms, stating:

“The accused person has consistently cooperated with investigators and complied with summons as and when required,”defence said.

Counsel further informed the court that there is another pending matter involving the accused before Court 7, scheduled for hearing on June 25, 2026, and requested that the current case be placed before the same court, stating that the matters are related.

The defence also applied for disclosure, asking the prosecution to supply all documents it intends to rely on during trial to allow adequate preparation of the defence case.

In mitigation, the defence told the court that the accused is a single mother of a one-and-a-half-month-old baby, the sole breadwinner for her family, and also supports her elderly parents.

The court was further urged to consider her personal circumstances when determining bond terms, stating:

“She undertakes to comply with all bond terms and will attend court as required,”said the counsel.

The prosecution did not file any affidavit opposing the bail application at the time of the hearing, with the defence arguing that no sufficient grounds had been presented to deny bail.

The matter will be mentioned for further directions as the court considers bail and case management issues, including disclosure of evidence.
