The court also heard that the offence allegedly occurred on October 13, 2023, at the National Criminal Investigations Academy in South C, Nairobi, where he is said to have misled a police officer.
The prosecution told the court that it was not opposing his release on bond but requested that the matter be mentioned after two weeks for pre-trial directions.
“The prosecution does not oppose bond but prays for a mention in two weeks for pre-trial directions,” the State told the court.
Defence counsel appearing for the accused informed the court that there was another matter pending before the Environment and Land Court (ELC No. E418 of 2021) connected to the case and urged the court to grant adequate time to enable proper preparation.
Chief Magistrate Lucas Onyina released Brian Torotich on a cash bail of Sh 50,000 with one contact person required.
The matter was then allocated to Court 9 for further directions.
“The defence be supplied with copies of witness statements and documentary evidence the prosecution wishes to rely on.”
The case will be mentioned on May 19, 2026, for pre-trial directions.
