Court Declines Bid to Terminate Sh356 Million Theft Case Against Company Director,Honey Khatwani

A Nairobi court ordered the continuation of a criminal case against a company director accused of stealing more than sh356 million from a company where he served in a senior management role.

Milimani Chief Magistrate Rose Ndombi dismissed an application by the prosecution seeking to withdraw the case against Honey Khatwani, a director of Oki General Trading Limited, saying the grounds presented were insufficient to warrant the termination of proceedings.

According to the charge sheet, Khatwani is accused of stealing sh356,711,174.40 belonging to the company between January 2020 and June 2024.

The prosecution alleges the funds came into his possession through his position as a director. He has denied the charges.

The State had asked the court to discontinue the matter under Section 87(a) of the Criminal Procedure Code, arguing that the dispute had also been pursued through civil litigation and that discussions aimed at resolving the matter had taken place.

However, the court found that the existence of parallel civil proceedings was not enough to justify halting a criminal trial.

In rejecting the application, Magistrate Ndombi said the court was not convinced that sufficient reasons had been provided to support the withdrawal request.

The court also considered objections from the complainant, who maintained that issues surrounding the dispute had not been fully resolved and opposed the proposed withdrawal.

As a result of the ruling, the criminal case will proceed before the Milimani Law Courts, where Khatwani will continue to face the charges against him.

The magistrate also directed that allegations raised during the proceedings be subjected to further investigations, while noting that any findings would depend on the outcome of the inquiry process.
